SR-22 Insurance in California

What it is, who needs it, how to file, and how much it costs — your complete 2026 guide

What Is SR-22 Insurance?

An SR-22 is not actually a type of insurance — it's a certificate of financial responsibility that your insurance company files with the California DMV on your behalf. It proves that you carry at least the state minimum liability insurance coverage.

Think of it as a guarantee from your insurer to the DMV: "This person has active insurance, and we'll notify you immediately if their coverage lapses."

💡 Common Misconception

SR-22 is NOT a special type of insurance policy. It's a form your existing insurer files with the DMV. You still get a normal auto insurance policy — you just have an SR-22 endorsement attached to it.

Who Needs SR-22 in California?

The DMV or a court may require SR-22 filing if you:

  • Were convicted of DUI or DWI
  • Were caught driving without insurance
  • Had your license suspended or revoked for any reason
  • Were involved in an at-fault accident without insurance
  • Accumulated too many points on your driving record
  • Refused a chemical test (breathalyzer/blood) during a traffic stop
  • Were convicted of a hit and run
  • Received a court order requiring proof of financial responsibility

DUI offenders are the most common SR-22 filers in California, but you don't need a DUI to need an SR-22.

How to Get SR-22 Filed

1

Find an SR-22 Insurance Provider

Not all insurance companies offer SR-22. You may need to switch to a carrier that specializes in high-risk insurance. Our sister company, FasTrak Insurance, handles SR-22 filings daily.

2

Purchase or Update Your Policy

You'll either add SR-22 to your existing policy or purchase a new policy with SR-22 included. You need at least California minimum liability coverage: 15/30/5.

3

Your Insurer Files the SR-22

The insurance company electronically files the SR-22 form with the California DMV. This typically happens within 24-48 hours.

4

DMV Confirms Receipt

The DMV updates your driving record to reflect active SR-22 status. You can verify filing at dmv.ca.gov.

5

Maintain Continuous Coverage

Keep your policy active with no lapses for the entire required period (typically 3 years). Any gap triggers automatic re-suspension.

How Much Does SR-22 Cost?

The SR-22 filing fee itself is typically $15-$50 (one-time). However, the real cost is the insurance premium increase:

FactorImpact
SR-22 filing fee$15 - $50 (one-time)
Average monthly premium increase$50 - $200/month
3-year total extra cost$1,800 - $7,200
Average annual SR-22 policy (full coverage)$2,400 - $6,000/year

Factors that affect your rate: driving record, age, location, vehicle type, coverage level, and which carrier you use. Shopping multiple carriers can save hundreds per year.

How Long Do You Need SR-22?

In California, the standard SR-22 requirement is 3 years from the date of reinstatement. The clock starts when your license is reinstated — NOT when you file the SR-22.

  • DUI conviction: 3 years
  • Driving without insurance: 3 years
  • Multiple violations: 3 years (may be longer)
  • Chemical test refusal: 3 years

⚠️ Important

If your SR-22 lapses at any point during the 3-year period, the clock resets. Your license will be re-suspended and you'll need to start the 3-year period over again.

What Happens If SR-22 Lapses?

If your insurance company cancels your SR-22 policy (for non-payment, cancellation, or any reason), they are legally required to notify the DMV immediately by filing an SR-26 form.

The consequences of a lapse:

  1. Immediate license re-suspension by the DMV
  2. 3-year SR-22 clock resets — you start over
  3. Additional reinstatement fee ($125) to get your license back again
  4. Higher insurance rates when you reinstate — a lapse makes you even higher risk
  5. Potential criminal charges if caught driving during the lapse

Non-Owner SR-22 Policies

Don't own a car? You still need SR-22 to reinstate your license. A non-owner SR-22 policy provides the required proof of financial responsibility without insuring a specific vehicle.

  • Covers you when driving borrowed or rented vehicles
  • Typically cheaper than standard SR-22 ($30-$80/month)
  • Satisfies the DMV's SR-22 requirement
  • Can be upgraded to a standard policy when you get a vehicle

Frequently Asked Questions

Does SR-22 show up on my driving record?

Yes, the SR-22 requirement is noted on your DMV record. However, it does not appear on background checks or credit reports.

Can I get SR-22 with a different company than my current insurer?

Yes. Many people switch to a carrier that specializes in SR-22 to get better rates. You don't have to stay with your current insurance company.

What's the difference between SR-22 and FR-44?

FR-44 is a similar form used in Virginia and Florida with higher coverage requirements. California only uses SR-22.

Will my SR-22 rate go down over time?

Yes. Most carriers reduce rates over time as your driving record improves. After 3 years with no violations, your rates should drop significantly once the SR-22 requirement ends.
